Welcome to Martin Landscape & Lawn Care. These Terms and Conditions outline the rules and regulations for the use of our website (martinlandscapeandlawncare.com) and the services we provide.
By accessing this website or hiring us for services, we assume you accept these terms and conditions in full. Do not continue to use Martin Landscape & Lawn Care’s website or services if you do not accept all of the terms and conditions stated on this page.
1. Services Provided
Martin Landscape & Lawn Care provides professional landscaping, hardscaping, fencing, seasonal clean-ups, and landscape maintenance services. The specific details, scope, and pricing of any project will be outlined in a formal, written estimate or contract provided to you prior to the start of work.
2. Estimates and Pricing
- Free Estimates: We provide free initial estimates for our services. While we strive to make these as accurate as possible, an estimate is not a legally binding contract until formally accepted and signed by both parties.
- Unforeseen Conditions: If unforeseen conditions (such as hidden rock, poor soil conditions, or unmarked private utilities) are discovered during the project, additional charges may apply. We will always communicate these changes to you for approval before proceeding.
3. Property Access and Client Responsibilities
- Access: The client agrees to provide our crews with safe and clear access to the property during scheduled service times.
- Pets and Debris: For the safety of our crew and your pets, please ensure all pets are kept indoors and the yard is free of pet waste, toys, and large debris before our arrival.
- Utilities: We will contact 811 (Dig Safe) to mark public utilities before digging. However, the client is solely responsible for marking all private utilities, including sprinkler lines, invisible dog fences, private gas lines, and septic systems. We are not liable for damage to unmarked private utilities.
4. Payment Terms
Payment schedules will be outlined in your specific project contract. For large installations (hardscaping, fencing, design), a deposit is typically required to secure your spot on our schedule and purchase materials. Ongoing maintenance plans (billed starting at $175/visit) will be invoiced on a set schedule. Late payments may be subject to additional fees.
5. Warranties and Living Materials
- Hardscaping & Fencing: We take pride in our craftsmanship, using premium materials like Selkirk Cedar and galvanized U-Line posts. Workmanship warranties will be outlined in your specific project contract.
- Plant Material (Sod, Trees, Shrubs): Because plants are living things, their survival depends heavily on proper watering, weather conditions, and ongoing care. As our family philosophy says, “the grass is always greener where it’s watered.” We cannot guarantee the survival of plant material once it is installed and handed over to your care, unless a specific watering and maintenance contract is signed with us.
6. Cancellations and Rescheduling
We understand that life happens. If you need to cancel or reschedule a maintenance visit or project start date, please provide us with at least 48 hours’ notice. Weather is a major factor in our industry; Martin Landscape & Lawn Care reserves the right to reschedule services due to heavy rain, extreme temperatures, or unsafe working conditions.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Martin Landscape & Lawn Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our services or website.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Kansas. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of Kansas.
